Terms of Service

By accessing or using any software product or service provided by Skynode (Pty) Ltd ("Skynode", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our products or services.

2. Description of Services

Skynode provides cloud-based and offline-capable software solutions built for South African businesses, including but not limited to Tafela, Indlu, Wakha, and Lungisa. Each product may have additional terms specific to its functionality.

3. User Accounts

To use certain features of our products, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

4. Licence and Use

Subject to these Terms, Skynode grants you a limited, non-exclusive, non-transferable, revocable licence to access and use our products for your internal business purposes. You may not sublicense, resell, distribute, or make our products available to third parties without our prior written consent.

5. Prohibited Conduct

You agree not to:

  • Reverse engineer, decompile, or disassemble any part of our products
  • Use our products for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Transmit any viruses, malware, or other harmful code through our products
  • Use our products in a manner that could impair or disrupt their performance

6. Payment and Billing

Paid plans are billed in South African Rands (ZAR). All fees are exclusive of VAT unless stated otherwise. You agree to pay all applicable fees for the plan you select. Failure to pay may result in suspension or termination of your access to our products.

7. Intellectual Property

All intellectual property rights in our products, including software, designs, logos, and documentation, are owned by Skynode (Pty) Ltd. Nothing in these Terms transfers any intellectual property rights to you beyond the limited licence granted herein.

8. Limitation of Liability

To the maximum extent permitted by South African law, Skynode shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use our products.

9. Disclaimer of Warranties

Our products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We may suspend or terminate your access to our products at any time if you breach these Terms or for any other reason at our discretion, with reasonable notice where practicable. Upon termination, your licence to use our products ceases immediately.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our products after such changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of our products shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
