Abaphristi nama-SGB avame ukuchitha emaviki ebhala noma ebuyekeza ithempulethi yemthetho wetikolo yaseNingizimu Afrika etikolweni tingasebenzise ngempela, bese kutholakala ukuthi amagama ayacacile, inqubo efanele ayikho, noma umbhalo awuhambisani ne-SASA Section 8 ne-9. Yini Umthetho Wetikolo Ngaphansi kwe-SASA?
Umthetho wetikolo ngumbhalo wenqubomgomo owembula imithetho, lokulindelwe, nezinqubo zokuziphatha kwabafundi, ukulawula, namalungelo etikolweni. Ngaphansi koMthetho Wetikolo taseNingizimu Afrika (Act 84 of 1996), umphakatsi wonke wetikolo (SGB) kufanele wamukele umthetho ohambisana nezingidingo ze-SASA noMthethosisekelo waseNingizimu Afrika.
SASA Section 8(1) idinga ukuthi wonke itikolo temphakatsi kufanele lamukele umthetho wabafundi ngemva kokuxoxisana nabafundi, abazali, nabafundisi. Umthetho kufanele uhambisane noMthethosisekelo nemthetho wesifundazwe osebenzayo, futhi kufanele ushicilelwe emilimini yesikhungo esebentiswayo etikolweni.
SASA Section 8(2) icacisa ukuthi umthetho kufanele uqukathe imigomo yenqubo efanele, kuhlanganise ilungelo lokuzwa, ilungelo lokukhalima, nelungelo lokwaziswa ngezinsolo ezibhekiswe kubo. Lokho kuqinisekisa ukuthi izinqubo zokulawula zihlonipha amalungelo abafundi ngokudignity, ukulingana, nesenzo sokuphatha esilungile.
Umthetho ukhosela izinhloso eziningi: uvikela amalungelo abafundi, usungula lokulindelwe ngokuziphatha ocacile, unikeza izinqubo zokulawula ezilungile, uqinisekisa ukuhambisana ezinqumweni zokulawula, futhi udala indawo yokufunda ephephile, ehloniphekile.
